**2.1.6. SERA.3125 Parachute descents**
Parachute descents, other than emergency descents, shall only be made in accordance with the following provisions:

(1) Parachute descents are only permissible as VFR flights and in visual meteorological conditions according SERA.5001 [ENR 1.2, item 1.].

(2) In any case, prior commencing a parachute dropping flight the parachute jumper shall make himself by all possible means thoroughly familiar with all available weather information and weather forecasts which may be relevant for the parachute descent.

(3) In any case, prior commencing a parachute descent the parachute jumper shall convince himself no risk of collision will exist during the descent. If required, his observation of the airspace shall be supplemented by observations by other persons (e.g. by the pilot or an observer on ground), who shall transmit their observations to the parachute jumper by a priorly agreed means.

(4) Parachute descents at controlled aerodromes and in their vicinity are only permissible with the permission from the aerodrome control tower or, at military aerodromes, except in case of joint use according § 62 para 3 LFG (aviation act), with the permission from the military flight operation office. Parachute descents which are conducted wholly or partly within controlled airspace are only permissible with the permission from the appropriate air traffic control unit. Within controlled airspace the required permission shall be obtained for each descent.

(5) Parachute descents at uncontrolled aerodromes and in their vicinity are only permissible with the permission from the aerodrome operator.

(6) The permission according para 4 shall only be granted if this does not constitute endangerment of controlled flights or aircraft participating in the aerodrome traffic. It shall be issued with requirements, restrictions and conditions as necessary to maintain safety of aviation. It shall be revoked if one of the prerequisites is not met or not met any more or if conditions have been violated.

(7) The aircraft used for the parachute dropping flight shall maintain watch in radio communications with the appropriate air traffic control unit, or an air traffic services unit having received commission by this air traffic control unit, within military reserved areas with the appropriate military flight operation office, during parachute descents within controlled airspace or at controlled aerodromes and their vicinity according SERA.8035 [GEN 3.3, item 3.3.7.1. and 3.3.7.1.1.].

(8) Exemptions from the requirement regarding maintaining watch in radio communications (para 7) are only permissible with permission from the appropriate air traffic control unit or military flight operation office.

(9) Parachute descents at night are only permitted:
1. At controlled aerodromes and in their vicinity with approval of the relevant aerodrome control unit or
2. Outside these areas with approval of the area control unit or relevant approach control unit or within military reserved areas with approval of the military flight operation office.
These approvals have to be requested for every descent.

(10) The approvals according para 9 shall only be granted if the aircraft used to carry the parachute jumpers is maintaining two way radio communication according SERA 8035 with the relevant ATC unit or a delegated ATS unit and public interest in air safety is not in doubt.

(11) General requirements for parachute descents may be determined by the aeronautical agency 'Luftfahrtagentur/ LFA' of Austro Control GmbH and are to be published in the common way used in aviation (especially AIP).
